Website and Member’s Area Terms of Use

Loan Market Group Pty Limited ABN 83 105 221 967 of Level 26, 111 Eagle Street Brisbane, Queensland, 4000 trading as Brokerversity (weourus), maintains this website (https://brokerversity.com.au) (Website) and the Brokerversity Member’s Area on the website (Member’s Area) for your information and convenience. This document sets out the terms and conditions that govern the use of this Website and the Member’s Area (Terms).  Please review these Terms carefully, especially the disclaimer and limitation of liability sections.  By accessing this Website (other than to read these Terms for the first time), or by registering or requesting access to, or accessing, the Member’s Area, you accept and agree to these Terms.  You must not use this Website or Member’s Area if you do not agree with these Terms.

This Website and Member’s Area was prepared for use by Australian users only, and may not satisfy the laws of other countries. You should not use this Website if you do not reside in Australia.

To the extent permitted by law, we may change these Terms at any time. Please check these Terms at regular intervals for any changes.  We will use reasonable endeavours to give you prior notice if we make any changes to these Terms that are adverse to any products or services that you have paid for on the Member’s Area.  In the case of any breach of these Terms, we reserve the right to seek all remedies available at law or in equity.

Use of the Member’s Area is entirely optional.  You may cancel your User Account at any time by contacting us at hello@brokerversity.com.au

Use of this Website and Member’s Area

You are responsible for all of your activity in connection with accessing and using this Website and Member’s Area.

You must not use this Website and Member’s Area for any activities that breach any laws, infringe any party’s rights or breach any standards, content requirements or codes promulgated by any relevant authority. You must not distribute through this Website any inappropriate communication or any virus or other disabling code in any form.

You must not bypass any security mechanisms imposed by this Website or Member’s Area, or tamper with, hinder the operation of or make unauthorised access or modifications to this Website or Member’s Area.

Registration to Member’s Area

You may register and create an account on the Member’s Area (User Account) by following the registration process.  To use any feature of the Member’s Area you must have a User Account.  

As part of the User Account registration process, we will ask you to provide or confirm information such as your name, your work email address, your work phone number and your job role.  Following the registration process, you may be asked to provide further information about you when using certain features of the Member’s Area (some of the information request are optional).  You must ensure that all information (including any personal information) that you provide is true, complete and accurate.  The registration form may include pre-populated information based on your pre-existing relationship with us.

You are responsible for ensuring that the information stored on the Member’s Area is up to date.

We may refuse to create a User Account or suspend or cancel your User Account, if we suspect that any information that you provide is not correct, that you are not eligible to use the Member’s Area or your User Account has been misused or you have committed a material breach of these terms and conditions.

Access to Member’s Area is subject to logon system link to your User Account (when your account is registered), or, where applicable, single sign on with our “MyCRM” system.  You must keep safe and secure all security credentials (such as username and password) associated with your User Account (Security Credentials), and you must not disclose them to anyone else or allow anyone else to use your User Account.  You are entirely responsible for any access to or use of the Member’s Area through your User Account, and you acknowledge and agree that any access to or use of the Member’s Area by means of the Security Credentials associated with your User Account is deemed to be access or use by you (other than any unauthorised use by our own staff). 

Functionality and content of the Member’s Area

The Member’s Area will include such functionalities, features and content as determined by us from time to time.  We may make changes to the Member’s Area, including by adding, amending or disabling existing features.  We will use reasonable endeavours to give you prior notice if we make any changes that are adverse to any products or services that you have paid for on the Member’s Area.

We may from time to time carry out regular or emergency maintenance of the Website or Member’s Area which may impact on the availability or your use of the Member’s Area.

Without limiting any other provisions of these terms and conditions, we may discontinue providing the Website and the Member’s Area at any time by giving you at least 3 months prior notice.

Disclaimers relating to the Website and Member’s Area

We do not warrant that access to this Website or Member’s Area will be uninterrupted, or that the services and features offered on this Website will be error-free. We reserve the right to change or discontinue any feature on this Website, the availability of this Website and the minimum web browser requirement to access it.

The information on this Website and Member’s Area is provided for information purposes, general interest and enquiry only, and is not professional advice, or financial advice. While we use reasonable efforts to ensure that the information on this Website and Member’s Area is complete and up to date, to the extent permitted by law, we make no warranty or representation as to the accuracy, currency or completeness of any information on this Website or Member’s Area.      Information may change without notice. Before relying on any information on this Website or Member’s Area, you should first verify the currency and accuracy of the information and its relevance. This may mean contacting our personnel before relying on any information on this Website or Member’s Area.

The information on this Website and Member’s Area should not be taken as constituting financial advice from us and we are not acting as accredited financial advisers.

To the extent permitted by law, we exclude all other warranties, guarantees, terms and conditions (whether express, implied or statutory) relating in any way to this Website, the Member’s Area, its content or its use. Our liability for breach of any warranty, guarantee, term or condition implied into these Terms which cannot be excluded is limited, where permitted by law, to the re-supply of that part of this Website or Member’s Area again or, at our option, the payment of the costs of having an equivalent service supplied again.

Confidentiality

You agree to keep all information (including videos, presentations and downloadable materials) contained, uploaded or viewed on the Member’s Area confidential and not      disclose the information to any other person.  You may only use the information in the Member’s Area solely for your own personal development and education purposes.      

Promotional Codes

From time to time we may provide you with promotional codes to access content at no cost or for a discounted rate. Promotional codes are not transferable or redeemable for cash or credit and will be valid for a limited time only. We reserve the right to modify or cancel promotional codes at any time.

You must not disclose promotional codes to anyone else or allow anyone else to use the promotional codes provided to you.

User Generated Content

The Member’s Area may allow you to upload posts, comments and other attachments (including      features such as social forums) (User Content) and may also allow you to see User Content submitted by other persons.

By posting, commenting, submitting, updating, modifying, transmitting or otherwise making available any User Content on the Member’s Area:

  1. you warrant that you independently created or otherwise have all the necessary rights and permissions needed to submit User Content to the Member’s Area;
  2. you grant to us a royalty-free, non-exclusive irrevocable, perpetual and world-wide licence of the intellectual property rights in the User Content to use, modify, copy, sub-licence, distribute, reproduce, adapt, transmit, publish and/or broadcast, publicly perform, communicate and display the User Content in any manner and by any means which we may determine;
  3. you must ensure, and warrant, that your User Content, and the licence that you grant to us under paragraph (2), do not infringe the rights (including intellectual property rights, privacy and reputation) of any other person, and you agree to indemnify us against any third party claims arising from any breach of this paragraph (3); and
  4. to the full extent permitted by law, you consent to us (and all persons authorised by us) doing anything in relation to your User Content which would otherwise constitute an infringement of your moral rights that you may have in the User Content. To the extent that a waiver, rather than a consent, is required in any jurisdiction, then you waive any moral rights you may have.

We have the right, but not the obligation, to monitor and review User Content from time to time and we may, at our sole discretion and without prior notice to you, remove or edit any of your User Content for any reason (or for no reason at all).

Notwithstanding our right to monitor, review and edit any User Content, we are not obliged to do so.  We accept no responsibility or liability for any User Content.  In particular, you acknowledge and agree that we do not authorise, condone or endorse any User Content of any other user, and are not responsible for the accuracy, legality or decency of such content.  You are solely responsible for verifying the veracity of any claims or statements made in any User Content.

You acknowledge that your User Content will be displayed on the Member’s Area, and other users may use, view and download your User Content.  We are not responsible for how other users will use your User Content.  You should take care before posting anything sensitive or personal about yourself to any part of the Member’s Area that is accessible to other users of the Member’s Area.

Some User Content may refer to events or activities that are organised by other users of the Member’s Area (e.g social groups).  Unless expressly stated otherwise, we are not responsible for organising these events and activities, and do not authorise or endorse them.  You are solely responsible for determining whether to participate in these events and activities, at your own risk.

Some User Content may include offers by other users to borrow, lend, sell and buy items or services.  We are not responsible for and are not involved in such offers, transactions or services in any capacity, and we do not authorise or endorse them.  You are solely responsible for responding to such offers.  Similarly, if you post any offers as part of your User Content, you must ensure that you and your User Content comply with all applicable laws, and that your User Content is not misleading or deceptive.  You must not use the Member’s Area to offer or acquire any illegal products or services.

If you believe that your rights have been infringed by any other User Content, or wish to report any User Content that does not comply with these Terms, please contact us.

Permitted Use

We prohibit the use of the Website and/or the Member’s Area and any of its functionalities, features and content in any manner other than as expressly allowed by us in these Terms.  With respect to your use of or participation in any interactive facility on the Member’s Area (such as social forums), you acknowledge and agree that you are legally responsible for all User Content you submit and under no circumstances will you post any material, or engage in any behaviour, that is, or could reasonably be taken to be, predatory or intimidating, or in any way designed to solicit identifying information from anyone under the age of 18 years.

You will not:

  1. post or transmit any illegal, threatening, discriminatory, harassing, abusive, offensive, defamatory, racially or sexually vilifying, obscene, pornographic or indecent material of any kind (including Restricted or Prohibited Content in accordance with the National Classification Code), or any material in contempt of any court or parliament, or encourage any other person to do so;
  2. bypass (or attempt to bypass) any security mechanisms imposed by the Website or the Member’s Area;
  3. harvest or collect email addresses, photographs or personal information of other users;
  4. impersonate any person or entity;
  5. post or transmit false or misleading material or make any form of misleading or deceptive representation;
  6. knowingly post or transmit or permit the posting or transmission of any material, which contains a computer virus or other harmful data, code or material;
  7. exploit the Website or the Member’s Area for your own commercial or unlawful purposes or the commercial or unlawful purposes of any other person (including the posting of advertisements, solicitors, promotional materials, “spam” or any other materials that are contrary to our commercial or lawful interests);
  8. provide access or links to any material (including links to peer to peer network “trackers”) which may infringe the intellectual property rights of another person; or
  9. delete or alter or attempt to delete or alter attributions, legal notices, trademarks or copyright marks on any material contained in the Website or in the Member’s Area.

We may suspend or terminate your access to the Website or Member’s Area if you are in breach of this section.

Third Party Content and external training courses

This Website and Member’s Area may contain information and materials from third parties, including public comments, advertisements, feeds, data information, social media content and links to other websites (Third Party Material). We do not have control over, and are not responsible for, any Third Party Material (including its currency, accuracy or reliability). Unless expressly stated otherwise, we do not sponsor or endorse the Third Party Materials.

The Website and Member’s Area may also allow you to enrol in training courses offered by external third parties (External Courses).  While the Website or Member’s Area may provide you with an interface to enrol in and access the External Courses, and may pre-populate some of the forms relating to the External Courses, the External Courses are offered, charged for and provided by the applicable third party (External Provider) (and not by us).  The External Courses are governed by the terms offered by the External Provider, and you are responsible for making payment directly to the External Provider (using the payment methods offered by the External Provider).

Limitation of Liability

To the fullest extent permitted by applicable law, we exclude all liability for any loss or damage, including any consequential loss or indirect loss, loss of data or loss of profits, loss of profit, loss of reputation or loss of business arising in relation to the use or reliance of any part of this Website, or the Member’s Area, or any information on this Website (including any Third Party Materials, any recommendations or results generated by the Website or the Member’s Area, the inability to use any part of this Website or the features on this Website including the Member’s Area), whether or not it is caused by our negligence, and whether or not the possibility of loss was known to us.

Security

We take reasonable steps to protect the information that you transmit using this Website and the Member’s Area. However, we cannot guarantee the security of any information that you transmit to us using this Website and the Member’s Area. Therefore, any information you transmit using this Website and the Member’s Area is transmitted at your own risk. When using this Website and the Member’s Area, you must take precautions to ensure that you are not exposed to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. We do not accept responsibility for any such interference or damage to your systems which arises in connection with your use of this Website and/or the Member’s Area.

Intellectual Property

Unless otherwise indicated, we own or are licensed to use all intellectual property (including without limitation copyright, trade mark and designs) subsisting in the materials on this Website and the Member’s Area. We authorise you on a non-exclusive basis to reproduce and download the materials solely for use in the intended manner. Otherwise, to the extent allowed by law, no part of this Website may be reproduced, reused, retransmitted, adapted, published, broadcast or distributed without our prior written permission.

All names, logos and trade marks on this Website and the Member’s Area are the property of their respective owners. Nothing on this Website and the Member’s Area should be interpreted as granting any rights to commercial use or distribute any names, logos or trademarks, without the express written agreement of the relevant owners.

Privacy

We may collect your personal information through this Website and through the Member’s Area. We collect, use, hold and disclose your personal information so that we can perform our business activities and to administer this Website and the Member’s Area, to manage the training courses available on the Website. We respect your right to privacy, and subject to any agreement that you have with us, you may elect not to provide your personal information to us. However, if you choose not to do so, then we may not be able to respond to you.

In addition to using your personal information for the purpose for which it is given, we may also disclose your personal information to: (i) our employees, related bodies corporate, contractors or service providers for the purposes of operation of our website or our business, fulfilling requests or answering queries by you; (ii) suppliers and other third parties that supply services to us, for our business, marketing, and related purposes; (iii) regulators and law enforcement agencies; (iv) associated businesses that may want to market products to you;      (v) other organisations for any authorised purpose with your express consent; (vi) External Providers in connection with the External Courses offered by them that is accessible through the Website     s and (vii) lenders and credit providers with whom we have commercial relationships, to report on the enrolment and completion rate of training courses available on the Website that relate to those lenders or credit providers.

Our privacy policy, available at Privacy Policy – Loan Market Group, contains information about how you may access and correct the personal information that we hold about you and how to lodge a complaint relating to our treatment of your personal information, and how we will deal with such complaint.

You consent to your personal information being collected, used and disclosed in accordance with these Terms and our privacy policy. You must not submit the personal information of another person, unless that person has read, understood and accepted these Terms and our privacy policy.

We may contact you from time to time (including by email) in connection with your use of the Member’s Area, such as by letting you know of new content that you may be interested in.  You can change your email preferences at any time via your account settings or may opt out of this by contacting us at hello@brokerversity.com.au

General

If any provision of these Terms is found to be void, unlawful or unenforceable for any reason, then that portion of the provision which creates the invalidity, unlawfulness or unenforceability will be severable from these Terms remaining provisions.

These Terms are governed by the laws of the State of Queensland, Australia.

Brokerversity Payment Terms 

Loan Market Group Pty Limited ABN 83 105 221 967 of Level 26, 111 Eagle Street Brisbane, Queensland, 4000 trading as Brokerversity (weourus), offers services (such as subscription to training courses) through the Brokerversity website, including the Member’s Area (Site), for purchase, for use by you, as a Brokerversity Member (the Services).  This document sets out the terms and conditions that govern the sale and purchase of these Services (Payment Terms).  

Ordering and purchase of Services

You place an order for Services when you complete the order form on the Site and complete the “check out” process.  By ordering Services via the Site, you make a binding offer to purchase the relevant Services at the specified fees in accordance with these Payment Terms.  Processing and acceptance of payment do not indicate that your order has been accepted.  Your order is accepted only when we receive cleared funds from your select payment method and we enable your access to the purchased Services.  We may decline your order for any reasonable cause, including where the fees displayed on our Site were incorrect, or where the Site or the payment processing function is unavailability or defective.

The fees and payment methods

The fees displayed on the Site are quoted in Australian dollars.  All fees displayed on the Site are inclusive of applicable GST.  We may adjust the fees for our Services from time to time.  The adjustments will not apply retrospectively to any Services that you have already purchased, but will apply if you purchase the Services again, or renew the Services (for subscription Services).

The Site may accept payment from various payment methods.  The eligible payment methods are shown to you at checkout.  Some payment methods may attract additional charges, which will be shown as part of the fees displayed on the Site.  However, the fees on the Site will not show any fees or charges that may be imposed on you by a third party in connection with your choice of payment method.  You remain responsible for such fees and charges.

When you purchase Services on the Site, we will process your selected payment method via our selected third party payment processor.  You represent and warrant that the payment information that you submit on the Site to purchase the Services is true, correct and complete, and that you have the authority to use the payment information to make the purchase. 

The Site may allow you to reuse payment methods and payment information that you have previously used on the Site.  Such functionality is provided by our third party payment processor, and our Site does not store any payment information.  If you reuse payment information that you have previously used, you must ensure that the payment information remains up to date and that you remain authorised to use the payment information to make purchases.

You must ensure that you have sufficient funds available for payment.  If your payment method is declined, or a charge back or refund instructions is issued by our payment processor, then you must make payment via other means.  In the interim, we may suspend or terminate your access to the paid Services until the amount is fully paid.

Other terms governing the use of the paid Services

Your use of any paid Services are governed by the same Brokerversity Website Terms & Conditions that apply to the use of the Site.  By ordering a Service, you agree that you will comply with those terms and conditions.
